Social Security Disability
If you have become disabled, whether due to illness or injury, and can no longer work, how will you pay your bills, buy your food and medicine, care for your family? You may be entitled to monthly benefits from the Social Security Administration. Obtaining those benefits, however, can be a lengthy process, involving appeals and often a hearing before an administrative law judge.
Our attorneys represent claimants for Social Security disability benefits on a contingency basis. Social Security places a cap on the fee of $5,300 or 25% of the past due benefits due to the claimant, paid directly to the attorney by the SSA after a decision has been made. If the claimant is not found disabled under Social Security's rules, and thus not awarded benefits, no attorney fees are collected or due from the client.
Initial claims are generally opened by the individual, through the SSA. Should those claims be denied, a Request for Reconsideration must be filed within the time limit. It is at this level that our attorneys routinely begin their representation.
If the claim is denied a second time, a hearing must be requested before an administrative law judge. Pope McMillan's attorneys have successfully represented many claimants at the hearing level.
